Just this week, the Obama administration appealed to the 2nd Circuit Court of Appeals a district judge’s decision to grant a temporary injunction against the enforcement of the detention provision, which is found in the most recent National Defense Authorization Act, signed into law by Obama just last winter.
The notice states the Obama administration is appealing the preliminary injunction as well as an order from the judge that the injunction bars the enforcement of the provision against anyone. Further, the Obama administration is upset that the judge denied its motion for reconsideration.
At the same time, Obama administration officials have filed a memorandum with the U.S. District Court where Judge Katherine B. Forrest issued the injunction because of the possible injury to citizens, including the loss of their rights.
Her ruling came after Justice Department officials refused to affirm that the journalists and others who brought the lawsuit would not be subject to detention for their work.
Finally, a Judge that reads the US Constitution........God bless her.
She better get protection 24/7. This gang of thugs are the most ruthless, lawless group to seize power in the US. We need to continue organizing to fight these people on their terms. The brave must be protected. These slime must be arrested and prosecuted to the full extent of the law. Are you with us?

Permalink Reply by Johnny Smith on August 9, 2012 at 4:27am There are a few honest judges left that will uphold the constitution it appears. Hard sometimes to remember that. It is a great feeling to see some little piece of good news every now and then isn't it!
I came across this report and thought it is worth a real look as to a win if it turns out not to be a lie.
A member of Congress from Iowa, seeking re-election, has given a campaign stop audience in Iowa a hint about what he considers a possible solution for the laws and regulations that have been generated by the Obama administration: blanket repeal.
According to a report in the Messenger News, U.S. Rep. Steve King, who represents a portion of Iowa, made the suggestion this week at a stop in Humboldt.
He said he was thinking about introducing a bill, which if it became law, would repeal everything Obama has signed into law.
The issue arose as part of a conversation King, who is running against Democrat Christie Vilsack in the state’s 4th congressional district, was having over his plans to sue Obama over a White House decision to stop the deportation of some illegal immigrants.
“We’re going to defend the Constitution of the United States and the separation of powers,” King told the audience, according to the newspaper report, which estimated about 60 people were at the county fairgrounds event.
The legal action would address the executive order Obama issued to halt the deportation of illegal immigrants who arrived in the U.S. before they were 17 – and are not yet 30. Several other qualifications would apply.
King told the audience while the administration has discretion about what cases to prosecute, the president “does not have the ability to grant blanket amnesty to entire classes of people.”
The report said he reiterated his opposition to Obamacare and the massive federal spending that Obama has instituted.
Among the various agenda items from Obama that have proven controversial are Obamacare, the biggest tax increase in U.S., history, the new advocacy for open homosexuality in the U.S. military, and others.

Permalink Reply by Johnny Smith on August 9, 2012 at 1:54pm Yeah, I saw this a little while ago too Shane. I just hope as Col. Riley says, he'll walk the walk. Honestly though, unless he gets a lot of help from the results of this election it's just a pipe dream.
This effort is focused on sacrifice to protect and defend the Constitution of the United States against all enemies foreign and domestic.
