Before you look to do harm to Chief Justice Roberts or his family, it’s important that you think carefully about the meaning – the true nature — of his ruling on Obama-care. The Left will shout that they won, that Obama-care was upheld and all the rest. Let them.

It will be a short-lived celebration.

Here’s what really occurred — payback. Yes, payback for Obama’s numerous, ill-advised and childish insults directed toward SCOTUS.

Chief Justice Roberts actually ruled the mandate, relative to the commerce clause, was unconstitutional. That’s how the Democrats got Obama-care going in the first place. This is critical. His ruling means Congress can’t compel American citizens to purchase anything. Ever. The notion is now officially and forever, unconstitutional. As it should be.

Next, he stated that, because Congress doesn’t have the ability to mandate, it must, to fund Obama-care, rely on its power to tax. Therefore, the mechanism that funds Obama-care is a tax. This is also critical. Recall back during the initial Obama-care battles, the Democrats called it a penalty, Republicans called it a tax. Democrats consistently soft sold it as a penalty. It went to vote as a penalty. Obama declared endlessly, that it was not a tax, it was a penalty. But when the Democrats argued in front of the Supreme Court, they said ‘hey, a penalty or a tax, either way’. So, Roberts gave them a tax. It is now the official law of the land — beyond word-play and silly shenanigans. Obama-care is funded by tax dollars. Democrats now must defend a tax increase to justify the Obama-care law.

Finally, he struck down as unconstitutional, the Obama-care idea that the federal government can bully states into complying by yanking their existing medicaid funding. Liberals, through Obama-care, basically said to the states — ‘comply with Obama-care or we will stop existing funding.’ Roberts ruled that is a no-no. If a state takes the money, fine, the Feds can tell the state how to run a program, but if the state refuses money, the federal government can’t penalize the state by yanking other funding. Therefore, a state can decline to participate in Obama-care without penalty. This is obviously a serious problem. Are we going to have 10, 12, 25 states not participating in “national” health-care? Suddenly, it’s not national, is it?

Ultimately, Roberts supported states rights by limiting the federal government’s coercive abilities. He ruled that the government can not force the people to purchase products or services under the commerce clause and he forced liberals to have to come clean and admit that Obama-care is funded by tax increases.

Although he didn’t guarantee Romney a win, he certainly did more than his part and should be applauded.

And he did this without creating a civil war or having bricks thrown through his windshield. Oh, and he’ll be home in time for dinner.

Brilliant.

  • I have been giving this a-lot of thought over the last 24 hours and I was comming to the same conclusions.  I think  Chief Justice Roberts did us a favor.

    • Agreed...I believe The Chief Justice played his hand quite well...He defined the mandate as the TAX that it is...(Obama looks "very stupid" claiming it is not)..And if the States can "opt out"...suddenly the "national healthcare program" becomes a what it should have been in the first place,...an option!

    • YEP--We just had to start thinking instead of talking and letting our emotions run away with out common sense.  Now that I realize it, sure makes a lot of other people look pretty stupid!!

  • Yeah, but "the tax thing" is, at best, a pyrrhic victory for Americans.  Under this precedent, Uncle Sugar can make us do or not do just about anything by "taxing" us heavily for non-compliance.

    "Wanna buy a gun?  Sure, the Second Amendment is still in force, partner!  You can keep and bear your arm, no problem!  What?  Keep it at your house?  No, you have to store it at your local police department.  Well, yeah, you can keep it at home, but there is a $5000 per year tax on that.  Ammunition?  Sure!  Each round carries a $20 tax."

    "What?  You don't have solar panels on your roof?  Well, then, you have to pay a tax of three dollars per kilowatt-hour that you use from 'the grid'!"

    "You don't have an electric car?  Three-thousand-dollar-per-year tax on each of your other automobiles and motorcycles!"

    "You want to have a drink now and then?  You know, of course, that your federal government is responsible for your health care insurance and, by extension, your health.  Alcohol is really, really bad for you, so we have a program to discourage its use.  Each drink has a federal tax of forty dollars assessed.  Cigarettes?  Fugeddaboudit!  The federal taxes per pack are now two hundred and fifty dollars!"

    "Mr. Robert Jones -- SSN XXX-XX-XXXX:

    "In our new, cashless society, we can keep track of what everyone buys, and we have noticed, Mr. Jones, that you have not purchased any fresh vegetables for over two months.  Since we are now responsible for your health, we are concerned that you are not eating properly, not to mention your wife and two children.  The law requires at least four servings of fresh vegetables per person per week.  Since you are not in compliance with the law, we are forced to assess a 'tax' upon you of two hundred dollars per person per week of non-compliance.  This amount will be due when you file your income taxes for this calendar year.  Failure to comply will result in further enforcement action, from preventing you from making any purchases up to and including incarceration and, possibly, termination of your global citizenship.

    "Thank you for your cooperation in this matter, and, please, remember your responsibilities as a citizen of sub-nation America, the land of the free and the home of the brave!  If we can be of further assistance, don't hesitate to contact us.

    And on and on.

    America is finished.

  •    Justice Roberts could have called it a tax and still voted it down.Thats my opinion. Kicking the can down the road or passing the buck back to the people is a sham.

       Justice Roberts is not a ginious.He is a self serving ASS.

  • Harry, after first hearing of the SCOTUS decision yesterday I was infuriated. After a short time of reading the posts on this site I also started reading articles from sources that started to get more in depth into the decision. I am inclined to agree that there are some positive aspects to the results. One of the main ones being that all of us should do what I have done and forward the States Rights Act from patriotsunion.org to their state legislature and ask them to implement something similar or the same. The states need to assert their right to be free from the federal governments mandates and this may provide the incentive to do something about it. The other things mentioned in the article are good as well. Thanks.

  • MoxNix---either way we the people are screwed. All three branches of our Federal Govt. and both the Democratic socialists and the entrenched Republicrats  -- the Congress-- the Executive-- and the Judiciary  are all broken None of them defend the Constitution -nor the Greater good. If this ObamaCare Taxation without representation did originate in the Senate the Republicans allowed it to proceed. Now we are told those who did the damage are the one to fix the problem THEY CREATED --and we the beguiled  continue to play the game by their rules? June28 ,1787 Dr.Benjamin Franklin  How interesting that on that very anniversary  the US  supreme Court seemed to rewrite ObamaCare to  protect an Executive  that has violated the  Constitution so often--and a Congress that has done likewise. Franklin said they had created a Republic "if you can keep it"  we the people have been asleep and have allowed great harm be done.
