The Administration supports letting 11 south American countries sue Arizona and the 9th circuit agrees. the Holder wants them in the suit to make it an international argument so it is only a Federal government issue - what in the hell does the Obama use of Agencies to get around the Constitution? watch this, it will  make you so damn mad - ohhhhhh

 

War is coming with some one these guys are incompetent to defend America - they must really want to destroy the country from within - can not get congress to give them permission oh hell just do it and Reids Senate will protect us.

This appears to be more of an attempt to ridicule the President than vice versa. Of course, the criticism all began on FOX by two bimbos pretending to do news reporting. But let's see.

Arizona passed sb 1070 but the president and the justice department
questioned it's constitutionality. That doesn't mean it is or isn't Constitutional , it only means the federal courts need to clarify the matter. What anyone thinks at this point, including the President, foreign countries, Congress, or FOX News, will not determine whether SB 1070 is or isn't constitutional. The courts will decide without even considering and,  in spite of, the populous political drumbeat, and that's the way it should be. As Americans, we need to let the courts decide.

That the President could somehow influence the 9th Circuit Court is laughable. First, have you ever met a judge who did not have a huge ego and would refuse anyone toying with their choices in THEIR courtroom? The Constitution provides a separation of powers which makes the judiciary separate from the administrative branch of government, and experience has shown the 9th Circuit Court to be extremely independent. Yet, according to the two Fox geniuses, the Court's decision to accept amicus briefs from a dozen Latin American nations is all President Obama's doing, as if he somehow controls, or is able to control, these events. He can't! Rewatch the video and see how Monica and Megan "play" the viewer into thinking it is ALL Obama's doing. Megan is a lawyer and knows better and chooses, for her own reasons, to play along.

 

Don't get me wrong, I hope Arizona prevails and SB 1070 is finally ruled "Constitutional", but let's not elevate stupidity to the next level. Allowing foreign countries to file amicus briefs neither equates to wrong doing by anyone nor proves that anyone hates his country.

 

This view has been available for at least two months, why is it a hot topic now?

Please reread my post.My point was, and is, this has yet to be resolved. Further, Obama had nothing to do with the addition of other countries. Please see the first two sentences of the second graph

 

All laws, contracts, agreements, commitments, are subject to interpretation which is why we have judges and courts. One may not agree with their decisions, however, they are one of the best things about America. If and when the Supreme Court of the United States decides (if it gets that far) then, and only then, will it be decided.

What do you mean "Obama had nothing to do with the addition of other countries". He is the President of the United States. This is what the man wants. Please ask yourself, why is Eric Holder suing a state in the first place? Don't you think his priorities are suspect?

You are overlapping two issues. O most certainly did not approach the other countries and encourage them to join the suit nor would any POTUS have it done nor does he have the power to prevent them entering. As to Holder suing AZ they are asking courts to decide the issue. Nothing unusual. Whenever there is a dispute the courts decide even if others think case law and the Constitution are clear.  Yes, it is that judge's view, that is why there is an appeal process. Not everything is evil, sometimes things are just as they appear.

How many cases on BOs eligibility have been thrown out for frivolous reasons? (YOU as an American have no standing in this issue. I took an oath to defend the Constitution. But I have no standing.)

Agreed, the 9th Circuit is a loose cannon. Look at the judges assigned, there is a broad spectrum of Presidential appointments from Reagan to Bush which is exactly how it was intended. There not a lot of Marxist judges hovering in a corner deciding issues to move Socialism forward. There must be 40 or 50 judges assigned to the 9th, maybe more. They are assigned by the Presiding Judge using a lottery just as it is done in almost all courthouses in America.

Our system was designed with three separate branches for a reason. Yes, O appoints federal judges but influence stops there. I believe the lawyers for the birthers may lack ethics. Why?  We, American citizens, do not elect Presidents, yes there is a popular vote that should be reflected in the voting of the Electoral College though that is not stipulated.  Thus, the Electoral College elects POTUS not American citizens thus, the lack of standing. Because birthers have not moved ahead does not mean O is the puppeteer, it means there is not legal cause for the issue to move forward.  I understand your concern but, I have read the transcripts of the court sessions and the lawyers can't even agree among themselves in front of the judge in open court. Sad, stupid that will not win any points with a judge. Read them yourself and see if you're impressed with their legal argument, you can read them online.

Look at an earlier post. Everything is subject to interpretation which is the purpose of courts. Well intentioned, good lawyers prepare documents with a bit of a slant favoring their clients though it must be subtle. Thus, judges must decide. I hope AZ wins. The U.S. Govt and AZ are asking judges to decide this issue. It is likely to go to the Supreme Court so it is not over until it's over.
