New Hampshire Ballot Access Challenges Against Ted Cruz and Marco Rubio Fail for Want of
                                                           Jurisdiction

Christopher Booth of Concord, New Hampshire, Cameron Elliott of Pittsburgh, Pennsylvania, and Robert Laity of Tonawanda, New York, filed ballot access challenges in New Hampshire against presidential contenders Senator Ted Cruz and Senator Marco Rubio, arguing that neither of them is an Article II natural born citizen.  The challengers are correct.

Still, the New Hampshire Ballot Law Commission refused to rule on the question of whether the senators are natural born citizens because, chairman Brad Cook said, the issues were not under the panel’s purview.

“Our precedents say we don’t’ go there,” Cook said. “Personally, would I like the U.S. Supreme Court to decide these issues so we know what is, so it doesn’t keep coming up? Absolutely. Are we the vehicle to start that discussion? No, we’re not.”

The Commission refused to rule, basically saying that it does not have jurisdiction over the question of whether Ted Cruz and Marco Rubio are Article II natural born citizens.  It also said that it would like the U.S. Supreme Court to rule on the issue.

On the merits, neither Ted Cruz nor Marco Rubio are natural born citizens.  Neither the original nor amended Constitution defines a natural born citizen.  The unanimous U.S. Supreme Court in Minor v. Happersett (1875) informed that we have to look outside the Constitution for its meaning.  It explained that at common law the nomenclature with which the Framers were familiar when the Constitution was adopted, all children born in a country to parents who were its citizens were "natives, or natural-born citizens," and that under that same common law all the rest of the people were "aliens or foreigners," who could be naturalized if they met the requirements of naturalization Acts of Congress. Minor v. Happersett (1875).

Cruz was neither born in the country, nor was he born to two U.S. citizen parents.  He was born in Canada, presumably to a U.S. citizen mother and a non-U.S. citizen father.  Unlike Senator John McCain, who was born in Panama to two U.S. citizen parents who were there to serve the military interest of the United States, neither of Cruz's parents were in Canada for purposes of serving in the U.S. military.  He therefore does not meet the definition of a natural born citizen.  Cruz is a citizen of the United States at birth only by virtue of a naturalization Act of Congress.  He is therefore not a "natural born citizen" of the United States by virtue of the common law.  A “naturalized born” citizen of the United States is not and cannot be a “natural born” citizen of the United States.

Rubio was born in the country.  But he was not born to two U.S. citizen parents.  He was born in the United States, but to two non-U.S. citizen parents.  Hence, he also does not meet the definition of a natural born citizen.  He is a citizen of the United States at birth only by virtue of the Fourteenth Amendment and not by virtue of the common law that provides the only definition of the clause.  He needs the Fourteenth Amendment because, while born in the United States, he was not born to two U.S. citizen parents.  Rubio is a "born citizen" of the United States only by virtue of the Fourteenth Amendment.  He is therefore not a "natural born citizen" of the United States by virtue of the common law. Simply being a born citizen of the United States under the Fourteenth Amendment does not make one a natural born citizen of the United States under the common law.
 
So, neither Cruz nor Rubio are natural born citizens.  It is treason upon the Constitution and the rule of law to see our political institutions kick the can down the road under the guise of want of jurisdiction.

Now - can you, or those filing protests against Cruz & Rubio, or anyone else explain the reason that this EXCITING NEWS ! was not raised about 'Barry S....' / aka Barak Hussein Obama - He DID ! register as a foreign exchange student toward admission to Occidental College - CA; and to Columbia University; and to Harvard University - again all under the self-description of 'FOREIGN EXCHANGE STUDENT'.  No legitimate birth certificate is found [ none carrying an indented State Of Hawaii official seal]. His biologic father was born in Kenya & never ! sought US citizenship. His paternal [?]aunt, living in Boston area, was adjudicated to be deported from US for falsification of her records. His brother, citizen of Kenya, showed certificates of birth of "Obama" in Kenya. Naturally, there is a lot ! more.!

     Now this EXCITING ! news that the GOP presidential candidate list will be culled based upon questionable citizenship ?!!!   wake up & smell the garbage !

It is time for every american citizen to get registered, and go to the polls and vote, because it is very apparent that the elite in washington d.c. intend to put their candidate in office once again. WE THE PEOPLE CAN STOP THIS, and if the elite does not listen we take the whole thing apart, because it is no long government by the people for the people.

At least some Republicans are practicing due diligence.

And then others, like you, bring nothing to the table but bitching and moaning.

Many have gone after Obama but a corrupt system has stymied and frustrated our efforts.

Stopping Cruz and Rubio may help us nullify Obama's usurpation at a latter time.

I did not take the time I wanted to write a more pointed reply to the discussion.

Nothing within my reply indicates a disagreement with the "Republicans ....practicing due diligence...".

The attempts & calls for removing Sen. Cruz,Sen. Rubio from the candidates' slate stands in glaring contrast to the utter failure of the political machinery of vetting Barry Soetoro / aka Barak Hussein Obama even from his initial campaign for the US Senate. This ruse on voters continued arrogantly & blatantly right through the presidential campaign. I'm sure you've read that the GOP candidate, Sen. McCain, stated not ! to challenge Obama as regards his claim to be a Christian. This current GOP presidential slate is, in the majority, a conservative slate; and, too, it is for the most part, a populist slate. This feature of the GOP slate, in & of itself, brought about explosive attempts to break up the slate by removal of Trump; challenges to Cruz & Rubio concerning 'eligibility, attempts by major media to discredit debates, & more.

   If their removal "...may help us nullify Obama's usurpation at a latter time....", then, it will be a moot point at the least. At most, nullification of Obama's presidency will break out a dam of reversals of all that he has done as President. This will, necessarily, bring about a near total breakdown of federal administrative politics & governance. This by nullification of executive orders [which any subsequent POTUS can direct]; and by nullification of federal laws passed - exclusively those passed by his signature - not those passed over his veto.

   Which is worse ? I do not know; nor do I have any possible conclusions as yet.

   If Trump wins the nomination - it's a moot point.

   If either Cruz or Rubio are pushed forward as vice-presidential candidates - we're in the same potential constitutional quagmire we're presently experiencing.

   If both Cruz & Rubio are adjudicated to be ineligible for presidential candidacy, the process feeds directly into Obama's & Democratic Party's engineered electorate plan of using hugely growing immigrant populations to swell the potential Democratic electorate. On the Net, there is verifiable documentation of voting by illegal immigrants; by non-citizen foreign nationals on 'green -card' & other statuses; by multiple voting minorities; by part-time college students [minorities & otherwise - must be a full time college student to meet federally adjudicated voting status].

   The Republican Party appears glaringly not to reflect the demands, petitions, nor consensus of its constituents. The Democratic Party is wholly controlled by leftist liberals [radical & otherwise]. For the most part, this is also reflected in state & local political governance also.

    Yes.... it's  a corrupted, power laden, swirl of breakdown of Constitutional governance - THAT'S GARBAGE !

     The removal of Cruz & Rubio will meet Constitutional muster. Their removal will display the sham persona of the Republican Party standing for a "government of laws", & similar. Too, it'll have little to no effect upon some 'ineligible' elected government officials already serving in office across the country at local, state, & federal levels.

    If this is "bitching & moaning...", then, yes, I stand guilty of your impression.

    My opinion is that it is more necessary to characterize & detail the foes of Constitutional Republic government before engaging in vain political debate, or in more direct acts of civil blowback against an oligarchy & leftist liberal dominated governance.

   I'm sure you've read through the many discussions here of the questions, "[What are we to do? What action can we take? How can we take any action against this?; etc.]".

But reading your tone tells me you're too stupid to understand that... or anything for that matter.

James Cavalieri............I would never consider judging Trump's relationship with Christ....only Trump know's that truth.  I don't know who I will vote for........but if Trump is the nominee of the republican party, I will most likely vote for him.  I certainly will not vote for Hillary Clinton, assuming she is the democratic nominee.

As we know, nothing in this world is a sure thing, certainly not among politicians......we  never know what we will get after election. 

The point of this thread is the "natural birth citizen" issue........I believe Trump meets that test...some others do not in my opinion.
