Civil Asset Forfeiture Reform:   

Although criminal forfeiture has been an important tool for law enforcement, civil asset forfeiture has been used to seize, forfeit and profit off property that may or may not be tied to criminal activity.   We must maintain vigilance and oversight over the federal civil asset forfeiture program because it is too ripe for abuse.   According to the U.S. Department of Justice, civil asset net forfeitures surged to $4.2 billion in 2012 which was up from $1.7 billion in the preceding year - a one-year increase of over 150%.   The proceeds have grown rapidly -- In 1986 the Federal Asset Forfeiture Fund took in $93.7 million; by September 2013 the Fund held more than $2 billion in net assets.   Additional safeguards must be implemented to ensure innocent property owners do not have property seized and forfeited without due process.   

To help curb actual and potential abuses and restore the balance of power back to individual citizens, I introduced H.R. 5212, The Civil Asset Forfeiture Reform Act, H.R. 5212 would:   

-Raise the level of proof necessary for the government to seize property.   

-Restore the principle of "innocent until proven guilty" by placing the burden on the government to prove a property owner had knowledge of criminal activity.  

-Increase transparency of civil forfeiture proceeds.  

-Restrict the use of equitable sharing agreements between Department of Justice and local/state law enforcement agencies that infringe upon state laws.
