I guess Lankford is not the Conservative he claims to be, if he sees any part of Obamacare that is worth keeping. But... There is a couple of people that are standing up to take this fight on. Here is your answer Twana.

Oklahoma State Rep to File Bill to Nullify Individual Mandate

OKLAHOMA CITY – State Rep. Mike Ritze plans to reintroduce a bill to “nullify” the individual mandate in the 2010 federal health care legislation in Oklahoma.

“I disagree with the Supreme Court’s ruling and believe that state governments were intended to serve as a check on the federal government,” said Ritze, R-Broken Arrow. “The Patient Protection and Affordable Care Act, which is better known as ObamaCare, is an example of federal overreach and my legislation will authorize the state to resist it and ban the enforcement of it.”

Ritze said his legislation would authorize the Oklahoma attorney general to defend citizens who fail to purchase health insurance against the federal government and criminalizes the enforcement of the individual mandate.

“My hope is that ObamaCare will be repealed, but I do not think that means we have to wait for the repeal to happen. Oklahoma lawmakers should do what they can to support our choice to make our own health care decisions,” Ritze said.

Activist: We must join forces to make health care plan work for Okl...

NORMAN — A Democrat and Republican agree that the Obama Administration’s health care plan is here to stay, at least for now, so politicians need to learn how to make the law work for Oklahomans.

Civic activist Jim Huff told about 75 fellow Cleveland County Democrats in Norman on Friday that state lawmakers need to take advantage of Medicaid benefits aimed particularly to uncovered children age 6 and younger.

“States can opt out of this,” he said, but it makes more sense for Oklahomans to opt for this kind of care rather than having those poor children show up in emergency rooms.

Republican U.S. Rep. James Lankford of Oklahoma City told The Associated Press earlier this week that he supports key reforms including coverage of a patient’s pre-existing conditions by health insurers and the transferability of insurance policies from one employer to another.

Overall, he wishes the Affordable Care Act was repealed.

Lankford noted that the GOP majority in the U.S. House has voted to repeal the health care legislation 26 times since it was signed into law by President Obama two years ago, but it is continually blocked by the Democrat-controlled U.S. Senate.

Huff, a longtime educator and major supporter of the American Federation of Teachers, noted that Oklahoma Gov. Mary Fallin changed her mind and opted to reject a $54.6 million federal grant to help create a health insurance exchange for uninsured Oklahoma residents, as required by the new federal law.

Federal law requires that by 2013, nearly every Oklahoman must be offered insurance coverage, so the U.S. government will intercede in Oklahoma to make it happen.

An estimated 700,000 Oklahomans _ one out of every five _ were without health insurance coverage in 2010, according to U.S. census data.

Huff said key components of the Affordable Care Act include a provision that will provide health insurance for 32 million uninsured Americans.

The act also bans lifetime limits on the amount of coverage a person can get which is “extremely important,” he said.

Already in effect is a clause that allows children under age 26 to keep their parents’ health insurance.

Listen as Amanda Teegarden of OK-SAFE knocks one out of the park as she exposes all of the privacy pitfalls of the Healthcare Exchanges (Obama Care) and how it is systematically being set up here in Oklahoma (and in other states) in spite of the fact that Oklahomans said no to Obama Care with our state question 756. This is truly Orwellian. Well worth the short 42 minutes if you are confused about the implications of state-run Healthcare Exchanges or federal - one is just as bad as the other. Amanda breaks down the healthcare subject and makes it much easier to understand.

Just a reminder that this upcoming June 26th is the primary election date and is now just over one week away. This will be the first time in recent history for the primary election to take place in June. There are several important primary races on the ballot including 3rd District Congressional, State Senate District 41, Oklahoma County Court Clerk, Logan County Sheriff and Logan County District 2 Commissioner. If this is your first time to vote since the redistricting of precincts you may review a list of precinct locations at hd31.org/maps.php.



Stopping the Property Tax on Intangible Assets

Over the past two years I have received a number of emails regarding the Business Activity Tax. This tax was put in place as a token $25 tax because of a ruling by the state court system. The court held that business owners are subject to personal property taxation upon intangible assets. An intangible asset is something of value that is not a physical object such as a building or piece of equipment. This might include a trademark, customer list or even goodwill built up by a company. The phrase “intangible asset” is defined as a non-monetary asset that cannot be seen, touched or physically measured.

This court decision could potentially have placed an enormous new property tax burden on Oklahoma's small business owners.

Following the court decision, the Legislature took action and passed the Business Activity Tax in order to meet the requirement of the court ruling. The $25 Business Activity tax serves as a tax in lieu of the personal property tax on intangible property. Businesses could claim an offsetting $25 tax credit to make up for the fact that they had to pay the tax.

The tax and credit were important because it held off a new and potentially substantial personal property tax. However, even though businesses did not suffer a net loss because of this tax, they were still forced to spend money paying accountants to complete the forms to pay the tax and claim the offsetting credit. This understandably generated a good deal of consternation from those who had to pay accountants and did not understand why they were being forced to complete the paperwork.

This year, the Legislature approved Senate Joint Resolution 52. I was glad to be one of the co authors on SJR 52 which would allow the people of Oklahoma to place a new provision in the Constitution to declare that Oklahoma businesses do not have to pay personal income tax on intangible property.

You will get to vote on SJR 52 this November. Your vote is especially important because advocates for the proposal claim that the intangible property tax would be the largest tax increase in the history of Oklahoma. They state that almost everyone in Oklahoma owns some form of intangible property that will be protected if the proposal wins approval.

Of course, if SJR 52 isn’t approved, the BAT will likely continue in lieu of the personal property tax. This will continue to be a headache for business owners.

Along with the proposal to drop the cap on property tax increases from 5% to 3%, the effort to stop the BAT and intangible property tax will be one of the most important state questions considered by voters in November.
