Constitutional Emergency

Thinking the unthinkable.  EO’s to be issued by a “president”, making it a LAW (entirely against the United States Constitution), violating the Due Process LAW as written in the Constitution.  Executive Orders, EOs, are not “law”.  EOs, according to the Constitution, is for the policy of a presidents administration only and not for the American people, ever.  So, where is it in the USC that EOs are discussed?

So, therefore, it cannot be done.  End of discussion.

Oliver North has an article we all must read, samples below under the picture.  Scriptural references will follow.

The current administration has an aberration that killing American Right Wing “Terrorists” can be executed as a danger to society no matter that we have a Due Process clause in the USC.  What would they say if any Right Wing Leader did the same from their administration.  What would be said?

As I have been saying for decades upon decades, “liberals”, “libtards”, “progressives”, “socialists”, “communists” accuse all others of what they themselves say and do and never admit to any wrong doing, ever.  In some manner, they manage to blame anyone and everything else on their own egocentric ideologies and those ideologies are the destruction of the very system they swear to defend and protect.  Remember the List of 45…memorize it…preach it…teach it.  It is all we have left to do if we don’t care about what God says about this all and the Bible does teach and preach about defective government leaders.

White House drones can assassinate Americans, but not tyrants By Oliver North, The Washington Times In my New York Times best-selling novel “Heroes Proved,” the president of the United States orders the execution of an American citizen in the United States by using precision munitions fired from a remotely piloted aircraft, or RPA — incorrectly referred to by our media as a drone. When the book came out last year, some critics derided the idea of a U.S. president issuing an executive order to kill Americans in our homeland as “over the top” and “unthinkable.” One even said the idea was “unfathomable.” Thanks to Sen. Rand Paul, Kentucky Republican, we now know the Obama administration already has contemplated such action. That ought to be troubling to every one of us. On March 6, Mr. Paul took to the floor of the U.S. Senate in a 13-hour effort to block the confirmation of John O. Brennan as CIA director until the administration handed over its “legal, procedural and constitutional justification” for such “extrajudicial executions.” The filibuster failed, and the Senate confirmed Mr. Brennan the following day. Yet the issues of constitutional protections for American citizens and the limits of executive power aren’t going away. Nor should they.

The Scriptures do teach that we are to “respect” our leaders and not “name-call” them or deride them.  The Scriptures also teach that defective government needs to be destroyed and at times with violence.  So, seeing that this seems to be a contradiction, when one studies this in the Scriptures, one notices that when a government is “not bad”, we need to respect them.  When governments are derisive and notoriously inept, they need replacing, peacefully “if possible”.

Thomas Jefferson, a Christian man and a believer in Jesus Christ said that we need a revolution every 20 years or so to relieve us of tyranny.  We are 10 times passed that time frame.

In my estimation, knowing what I know about the USC and the Holy Scriptures, an administration that subverts the very document he is to defend and PROTECT is in fact a defective and dishonorable man.  Period.  He needs to be replaced and apparently, he is trying to destroy his opponents in the next elections so he can remain in power?  Destruction is the only cure with much prayer and supplication.

Going after militia groups in the USA is considered to be an attack on Right Wing Terrorists.  (more here).  What happens when an obtrusive government attacks its own people using false reasons and false accusations because the models don’t fit their agenda?

There are many Scriptures that I can place here but I don’t want to print the entire Bible here.  It is time that you read these things for yourselves and make your own conclusions.  I will place one verse where it says to be “nice” and place one verse where it says we can be “bad”.

Titus chapter 3…

Put them in mind to be subject to principalities and powers, to obey magistrates, to be ready to every good work,

To speak evil of no man, to be no brawlers, but gentle, shewing all meekness unto all men.

For we ourselves also were sometimes foolish, disobedient, deceived, serving divers lusts and pleasures, living in malice and envy, hateful, and hating one another.

But after that the kindness and love of God our Saviour toward man appeared,

Not by works of righteousness which we have done, but according to his mercy he saved us, by the washing of regeneration, and renewing of the Holy Ghost;

Which he shed on us abundantly through Jesus Christ our Saviour;

That being justified by his grace, we should be made heirs according to the hope of eternal life.

This is a faithful saying, and these things I will that thou affirm constantly, that they which have believed in God might be careful to maintain good works. These things are good and profitable unto men.

Another verse is 1 Peter 3:13, 14.

Romans 13:1-8

Let every soul be subject unto the higher powers. For there is no power but of God: the powers that be are ordained of God.

Whosoever therefore resisteth the power, resisteth the ordinance of God: and they that resist shall receive to themselves damnation.

For rulers are not a terror to good works, but to the evil. Wilt thou then not be afraid of the power? do that which is good, and thou shalt have praise of the same:

For he is the minister of God to thee for good. But if thou do that which is evil, be afraid; for he beareth not the sword in vain: for he is the minister of God, a revenger to execute wrath upon him that doeth evil.

Wherefore ye must needs be subject, not only for wrath, but also for conscience sake.

For for this cause pay ye tribute also: for they are God’s ministers, attending continually upon this very thing.

Render therefore to all their dues: tribute to whom tribute is due; custom to whom custom; fear to whom fear; honour to whom honour.

Owe no man any thing, but to love one another: for he that loveth another hath fulfilled the law.

So, if we have leaders that do not follow God, and we are a Godly nation, we can fight to make it right.  If we accept the evil of government, what does that do to us besides making us servants of “the king”?

As I have said, there are many Scriptures of this topic.  Feel free to find your own and place them in the comments.

We also have a Constitution and a Declaration that gives us the power to “change”, don’t we?

Any EO from one president can be removed/nullified by the next president...most are left in place.

Time to clean out the 'presidential attic' of old EO's.

As Twana says, EO's have no authority except over the minions of government who report to the executive.  They are established as the means of asserting executive authority over the portions of government which are responsible to execute legislation properly passed, reviewed, and found to be constitutional, and thereby "law".

As a matter of principle, any legislation, any bill, anything put forth to initiate any legislative process which conflicts in whole or in part with either the exact wording or the intent of the principles established in the Constitution "is null and void at its inception" according to the principles of law in the constitution its self.

I strongly advocate our standing on first principles, confronting the whole of a criminal central government precisely because at least three quarters of this central not federal government has no legal foundation, and it would be a fool's game to try to convert the four fifths illegal government, back to one founded on principle.

Executive Orders have no legal existence per se, but exist solely because the chief executive has the authority to give orders for the execution of law, and those which fit in the framework of both the Constitution, and the law as legislated, become standing rules.

It is those issued as if they carried the same weight and authority, but are based on desires of the executive, and not on the "administration of the law by the executive" which are and should be in question, because they are exactly "orders", issued by one known as "chief executive", but unless they are exactly connected and fully in keeping with properly passed legislation, meeting standards, they have no legal purpose and no legal right to be issued.

While the "chief executive" is expected to issue orders, and we have seen now he has done so as per the law many times, we have seen far more orders which have no foundation, and are indeed, "null and void at their utterance", but we must have the fortitude to deny them and confront him with them.

When the emergency call hit the White House situation room, and that of the pentagon and many other places, he had the task and duty to issue an E.O.  He had an attack on sovereign Americans on Sovereign Soil, and the responsibility to defend Americans and American Sovereignty.  His issuing the order to stand down both in process rescue missions was a direct violation of his duty as chief executive and as Commander In Chief.

Regardless of his personal desires or goals, he swore an oath which he completely abrogated in issuing that "executive order", and in doing so, he has openly, on the record, committed High Treason.  His only lawful order he could give that night was to take every effort to end the attack.  The chief executive has no authority to choose whether to defend state department officials, nor does that executive have any authority to choose whether to defend American citizens, he could only legitimately taken the question before an emergency session of congress, tell the whole of the issue, and ask congress to declare war if he felt he did not have adequate resources to accomplish the mission his oath of office and the demands of his accepting the office required.

He had no right or authority to simply not fulfill his duty, yet in deciding not to allow rescue missions already well underway, he violated his exact duty as "chief executive", and he violated all military protocol in refusing to go forward with well designed rescue missions, the leaders of which, a two star Admiral and a two star General, each at the peak of their profession, felt were perfectly capable of successfully completing, each independently, even though they would have operated jointly, had they been allowed to move forward.

That he left the situation room in a "tantrum" ranting because two civilian contractors, former Seals, refused to listen and made him leave the room helpless, with nothing left to do except issue a standing order, no rescue efforts would be made that night, even while knowing the entire intent on his plan was destroyed by two Patriots who cared more for fellow Citizens, than about the fact they were unarmed, surrounded, outnumbered by hundreds, yet never flinched from "duty", left a situation room full of "professionals" who had all seen some sort of like situation, but never before such a response, left on their own to sit and watch the whole of it while able to do absolutely nothing.

If congress its self were not fully under the control of American Communists, he would have been impeached and tried.  Regardless of how any senate trial turned out, he would then have been tried by military tribunal, as a "commanding officer" who broke his oath, violated his standing orders, and disgraced his office.

We keep a civilian "commander in chief" to help prevent an easy military coup, however when a president takes action as "commander in chief", he is a military officer, and subject to the UCMJ, as well as the orders of president and the office.

We cannot clean out the literally millions of illegal laws, both trivial and important in any common way no more than Hercules could clean the Augean Stables with a shovel and rake.  Imagination easily shows the mass of filth Hercules faced outweighed the Stables themselves, so he turned a river, made a new course, and used the nature of the world to do the job.

We have an equal mass of "bad law", built on a total lack of principle, and to set it right by going through the stack is delving into a thousand to find the one, and looking up at the next thousand.  We must either accept our subjugation and total loss of our Nation in every way, or we have to gird our loins, prepare to go into battle with our fear subjugated by our Faith, and plan to take back our Own Sovereign Citizen Authority, and turn out the whole of the criminal bunch, throwing out all that was produced by them with them.

We can't get The Republic restored by any other means at all.  We choose to stand, in civil disobedience, ignoring the rules and laws ever changing, and face down their criminal attack on our natural rights, returning all of those who have chosen to be rulers, back to their place as "mere citizens" facing even their physical attacks which will come, and at that point we have the right and ability to then physically act and take our Nation back, establishing our own way exactly as our founders did when they concluded the articles of Confederation would not suffice as the foundation of a government.

We have to stand against the criminal acts, refusing to acknowledge them, and confronting legislators with their failure to do our bidding.  At the same time, we have to be ready to confront any attack, because our failure to obey means they have to prove their authority and power, or they show by default, they know they are criminal and wrong in their actions.

As "The sons of liberty" prepared for the two "Ships of the Line" filled with redcoats, intended to be "quartered" among those rebellious colonists, with their "night riders", "one if by land, two if by sea" preparations; the commander of the forces at Lexington, watching the red coats come out of the fog, "We have no desire for war, but we will fight for our rights.  If they want a war, let them fire the first shot, if it is to be such, don't fire till you see the whites of their eyes", as the standing order for our forces, facing down those soldiers sent to pacify us, and we must hold to the same standard, standing our rightful ground, aware of our Natural Sovereignty, sure of our purpose as true and right, and requiring those wrong to fire that first shot.

They don't want to do so, they have great fear of an awakened Nation, and being evil in their own right, they can't imagine a coming war in which evil won't prevail, but they fear others of evil intent more than they fear the righteous.  I am constantly told, no matter how right my facts are, no matter how true the depth and breadth of corruption and criminal accumulation of power, it is safer to just resist as much as possible, than to ever rise up willing to take on war for the return of our Nation.

They ignore history which says only "good men rising up" has ever turned around a Nation, and all which are not turned true, fall, leaving remnants for others to pick up and use or consume, as they see fit.  If there were no risk, if victory were assured, we never would have become so decrepit, so disgustingly twisted from principle and purpose, every generation would have eagerly risen to put down the least of crimes of government.

Yes, the way of revolution is treacherous and extremely dangerous, but allowing this Nation to fall calls forth no less an evil to assume control, and in fact, makes the way for greater evil.  Faith gives both purpose and the knowledge right can win.  Courage is what grows in the hearts of those who live by faith, and stand tall on principle, choosing the risk of personal destruction over living in fear.  We are either the descendants of The Founders, willing and able to risk it all, just as they did, or we deserve to live in subjugation, having failed the test of Faith.  Not to decide is to decide.

Semper Fidelis,

John McClain GySgt, USMC, ret.

"War is an ugly thing, but not the ugliest of things"...this is true.  The ugliest thing is not allowing God within our government, schools, etc, etc, etc.  We will pay the price.

My Dad was the last of the real "Tars", a Navy vet of years 1917-1925, wooden decks, wooden ships, Iron Men, a breed seldom seen since. He used to tell me about laws; he would frequently consult with one polotician or another about pending legislation and would tell the," you can pass a law demanding that all homes must have a set number of cock roackes, but folks a pretty likely to ignore your efforts."
