U.S. President NOT Commander in Chief Until Congress Calls Him

Words mean things, at least to Patriots.  Check out Article 2, Section 2 of our Constitution. How many of us have known and understood this?  I am ashamed to say I didn't, but as I study the U.S. Constitution I find much that needs to be understood as we enter into the perillous times ahead.  This make me ask the questions;




Sorry I could not stop myself from asking the obvious. I'm sure you can come up with more, like what about the Generals?

Everyone assumes as soon as a new U.S. president is sworn into office that they automatically become Commander in Chief of all of America’s military.  This is NOT true according to the US Constitution.

Article 2, Section 2 of the Constitution of the United States says,

“The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States.”

I'm not a Constitutional lawyer but I am pretty sure that statement really means he will be the Commander in Chief of the Militia of the several States when they, the state militias are call into service. Normall the state militias are under the command of their respective governors. I don't believe that statement refers to any Congressional action.

George is accurate. There is much precedence regarding the US President as "Commander in Chief" of the stipulated branches and members of the Armed Forces of the United States (excluding state militias/nat'l guards etc). So, no, the original post from Giacomo is misleading and not correct.

Once again I repeat myself that our school system has failed the American Public by failing to teach the basic history of our Nation. Many schools only go back as far as the Civil War and then only sparingly. Our Nation of voting, taxpaying, legal citizens are not given the basic premises of how, why and when this Nation was founded. Today, we are more concerned with being politically correct in our demeanor and shouldn't offend the delicate sensibilities of the extreme liberals and progressives. Let us show how mature we are in turning the other cheek and disregarding the many atrocities visited upon us by our enemies. Let us deny the facts! We allow the ever encroaching tyranny to overwhelm us all in the name of being politically correct! I am happy to say that the main stream conservative, silent majority, legal taxpaying citizens are finally waking up! We may be slow to react, but as we grow to realize that our complacency is to our detriment we do learn and will fight back. Our complacency is being replaced by knowledge. We are finally learning to dig deep into the wells of our history and heritage. As our forefathers have gone before us we shall go. I strongly believe that our country will survive. We are a strong People and proud of our heritage. We have made mistakes along the way, but as a child growing up, we learn and from what we learn we become the better and stronger for it. I am proud to be an American and what America stands for. For those that want to promote tyranny and their own self serving agendas that benefit the few I say beware! For we, the American Patriots, are awakening to your schemes and plots and will fight you to the very end. Read it as plain English, as it was intended. The reference to being called into the actual service of the U.S. is to the militia of the several states. They are wrong enough without our having to play these word games like they try to do.

I'm sorry I glossed over the comma that sets the "militia" seperate from the Army & Navy.  However since the "Militia" (National Guard) is part of the Army and as we have all witnessed in the past, the President only has to call them up as reinforcements to the regular Army which happens all of the time.  Maybe I am wrong, and the Nat'l Guard is just the reserve Army but where is the Militia that is under the command of the States Governors?  Something else to consider is the characterization of the Militias as a bunch of radicals or domestic terrorists by the FBI, Homeland Security, and Law Enforcement that seems to put them at odds with the government both State and Fed.  Also, where is it delineated "To provide for organizing, arming, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States, reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress” ?

 Reading this further, I believe that the article states that the President is the commander in Chief of the state Militias(National Guard) as well, IF they are called into service to defend the United States.  In other words he is the CIC of the US Armed Forces, including the NG if they are called into service to defend the US, not if they are called into service by that states Governor for duty in that state.

Problem is Congress has abrogated its' powers to any NGO -or to the Executive--or when they can work it to the Judiciary for  a very long time. .The more recent example is the decade or so since there has been a budget produced by the Democrats. Can anybody remember the last time Congress reminded the President that the US Constitution  declares it is Congress that has power to declare war. Not the President. but they want to keep "operational control"  All so they can claim somebody else is responsible --all so they can get reelected. IT is up to the People to insist that Congress again recognize the Powers delegated. IT is "We -the people " who have allowed Congress--and the Judiciary--and the Executive to become the Keystone cops -entertainment tonight they now appear to be. IT is We the people who have allowed the Judiciary to redefine their powers  to make this a House divided against itself. None of the elected-or appointed officials have any motivation to fix what we the people have allowed break.

Before making this an issue one needs to ask did congress do that for George Bush?  Dis they do it for GHW Bush?  Bill Clinton?  If they show it was done for all of them and not BHO then it needs to be looked into.

I guess Jerry, you believe in 2 wrongs make a right?  In my opinion violtions of the Constitution are the most egregious and anyone who violates it should be tried and found guilty of treason.  But then, in our permissive society anything goes right?  I think you forget Congress will not prosecute any government official of their own party or the other one for fear of pay backs when they are out of power.  The whole darn place is corrupt and I do not wish to let issues of this magnitude be ignored or swept under the rug.  That is what has been going on for far too long and we are now paying the price for it.
