  • When will the American Militia stand up? Militia !!?? My ass. The time to stand up and BE a Militia was when Lavoy Finnicum was murdered. Or back when Ammon Bundy and 30 others took a stand to defend Dwight and Steven Hammond. The American Militia is a thing of the past. That was back when men were MEN, And Americans stood up to defend the freedoms and liberties guaranteed by our CONSTITUTION.

    Ammon Bundy, his brother and co-defendants transformed the Malheur National Wildlife Refuge into a ramshackle camp this winter, manned the perimeter with military-style armed patrols and warned of violence against anyone who attempted to remove them while declaring the refuge a "base place for patriots from all over the country,'' prosecutors will argue this week.

    What a jury must decide is whether their actions and intent amounted to a crime.

    The trial pits the federal government against a group of self-described patriots who fervently believe public lands are in the wrong hands. The case will help to further establish when political protest protected by the First Amendment crosses the line into words and deeds that will send you to prison, and what the legal limitations are to constitutional guarantees of free speech, assembly and the right to bear arms.

    Seven defendants have pleaded not guilty to the federal charge of conspiring to impede U.S. Bureau of Land Management and U.S. Fish and Wildlife Service officers from conducting their work at the refuge through intimidation, threats or force. Five of the seven are also charged with possession of firearms in a federal facility. Two face an additional count of government property theft.

    Margaret L. "Margie" Paris, a law professor and former University of Oregon School of Law dean, said much is at stake.

    "The prosecutors must put to bed the crazy constitutional notions that the defendants have,'' Paris said. "They have to be able to get a conviction here and meaningful sentences because there are people waiting to repeat this activity. It'll be an important deterrent.''

  •    Ive been on this web site for a number of years now and have met some good people.We have blogged and protested and did some good in some cases.Thats not enough anymore.A man was murdered on his on land as far as I'm concerned and its been pushed aside.We paid to have this done on land we the people paid for.

    Ammon Bundy, Ryan Bundy, and their five co-defendants who are charged with are charged with “conspiring to impede federal employees at the Malheur National Wildlife Refuge.

    Ammon Bundy and others conspired to orchestrate the armed takeover of an Oregon wildlife refuge and made threats to the local sheriff weeks before the occupation began in early January, federal prosecutors told jurors here on Tuesday.

    But Bundy’s lawyer said their actions were meant to hold the federal government accountable, and that Mr. Bundy threatened no one.

    Ammon Bundy, who is on trial for heading up the occupation, is being represented by two Utah attorneys, Marcus M. Mumford and J. Morgan Philpot.  They argued on his behalf that Ammon Bundy’s intent was not to “interfere with a nature study,” but to return the land to the people, because “the federal government refuses to respect the limits of its powers.”

    Ammon Bundy’s own words from a January 2 video were used against him, to argue that they weren’t being prosecuted for holding a simple political protest, but for leading an armed occupation.

    Ryan Bundy is representing himself, and spoke directly to the jurors.  He showed a photo of himself standing beside his wife and children, said he was a family man who raises cattle, melon and children,” and his a member of the Mormon church.     With a Constitution booklet in his hand, he said he believes governments are designed by God, for man’s benefit, and that human law “should not suppress the freedom of the soul.”

    The Oregonian reported that about a dozen people were lined up outside the courthouse early Tuesday morning, and the courtroom was packed with relatives and supporters of the defendants, as well as media.

      Oregon sheriff David Ward said Ammon Bundy and his armed supporters repeatedly threatened “to overthrow” him and tore apart his small rural community, in the first testimony in the high-profile militia standoff case.

      Ward’s town is still recovering from the impact of the Malheur national wildlife refuge occupation, the sheriff told a packed federal courtroom in Portland on the second day of the trial.

      “We’re still dealing with a lot of the fallout,” he said.

      Ward, the local sheriff in rural Harney County, was thrust into the national spotlight at the start of the armed occupation, which began on 2 January when brothers Ammon and Ryan Bundy led a takeover of the Malheur national wildlife refuge to protest against the federal government.

    Read latest filing on challenge to Federal Ownership and Jurisdiction in USA v. Bundy et al.

    "The information disclosed on Friday has further allowed Mr. Bundy and his counsel to confirm with research why the issues presented with this case, the Hammonds case, and the Refuge generally, have generated so much controversy. With this additional information, we can trace Congressional action through to 1946, where Congress expressly directed that property acquired under these particular federal programs, including structures such as those built by the CCC where the occupation occurred, be “liquidated” and disposed of long ago. See 60 Stat. 1062. Accordingly, the Court can now see that – not only was the attempt by Mr. Bundy and others to assert an adverse possession claim over property at the Refuge not prohibited by federal law – it was invited, as Congress had expressly directed that the property be liquidated, opening it up as it were, to new entry and other possessory claims. Indeed, one might say this case presents an instance of the Executive Branch squatting on the Refuge land for decades, in defiance of Congressional action. In light of this history, one can better appreciate both why the occupation was so emotional for residents of Harney County supporting Mr. Bundy’s actions and why President Obama initially characterized it as “a local law enforcement matter.”
