Our troops should be able to, but ROE makes it a crime for them to do so. Actually Hussein obama takes away our troops rights under the constitution and at the very same time give those same constitutional rights to enemy combatants on battle fields in foreign countries to jihadis who are not even US Citizens. The muslim n chief is doing this to our troops and WE LET HIM AND THEM!
Since the U.S. has started serious discussions about taking military action against Syria, many have publicly spoken out against a possible military strike. And now it appears that some of our uniformed service personnel have come forward to express their disagreement with an attack, any attack on Syria.
More than 2,000 people have “liked” this image that was posted on Sunday.
There were also photos posted from people wearing the uniforms of the Marines, Navy and Air Force. These have also received Facebook “likes” in the thousands.
Is this kind of behavior allowed? Well, there are rules concerning what uniformed military personnel can and cannot do, especially when it comes to making a political statement. In reviewing the Uniform Code of Military Justice (UCMJ), Article 88 could come into play here. That section states:
Any commissioned officer who uses contemptuous words against the President, the Vice President, Congress, the Secretary of Defense, the Secretary of a military department, the Secretary of Transportation, or the Governor or legislature of any State, Territory, Commonwealth, or possession in which he is on duty or present shall be punished as a court-martial may direct.
We see that commissioned officers could be called to question if they posted a photo like those seen above. What about enlisted or non-commissioned personnel? The UCMJ has rules for these folks as well. According to Article 92, failure to obey an order could result in being court-martialed.
Any person subject to this chapter who–
(1) violates or fails to obey any lawful general order or regulation;
(2) having knowledge of any other lawful order issued by any member of the armed forces, which it is his duty to obey, fails to obey the order; or
(3) is derelict in the performance of his duties;
shall be punished as a court-martial may direct.

First, we in the military come under the Uniform Code of Military Justice (UCMJ) and as such we swore an oath to support and defend the Constitution against all enenies, foreign and domestic, and to obey all LAWFUL orders from "superior" officers and Non-Commisioned Officers, etc. The first issue is defending the Constitution against our enemies here and not from here, such as the illegal alien in the White House. I beleive the Secret Service members took a like Oath, but they have failed in their duties. They have not taken into custody the illegal alien pretending to be the king of the United States. The second issue is that which are considered LAWFUL orders. As I remember, any order that did NOT cause injury and/or death of innocent people or we as military personnel, was basically legal. There are some other exceptions. To ensure thatthe military personnel on active duty right now do not go to with the enemies of our country, at least 75% of them would have to disobey their orders. If 75% minimum disobey, where are the numb-nuts going to get the military police to arrest them and where are they going to keep them while awaiting trial? Remember Athens, TN in 1946? This is what the current bunch of Washington addle-pates need now! Semper Fi!
No, Twana, I retired 31 December 1982 at the request of the Corps. I had a heart attack on active duty, so I was asked to retire. However, the basic laws remain. We were required to support and defend the Constitution, but we were subject to the UCMJ. Kind of ironic, isn't it? You have a right to tell your bos he is an idiotic and that is that. Our military people call their boss an idiot and they can go to prison. I do have several clients that are still active and several more that served in Iraq and Afghanistan. We are all in agreement.
