FORT HOOD, Texas (AP) — Attorneys for the Army psychiatrist charged in the deadly Fort Hood shooting rampage have asked to further postpone his military trial until October.

Maj. Nidal Hasan’s (nih-DAHL’ hah-SAHN’) attorneys didn’t say during a pretrial hearing Wednesday why they want the trial postponed from June until October. The judge, Col. Gregory Gross, previously delayed it from March until June. He could rule on the matter next week.

Gross granted the defense team’s request Wednesday for a government-paid forensic pathologist to review autopsy reports. He denied prosecutors’ request to admit evidence before the trial, including 911 calls made from the Texas Army post during the November 2009 attack.

Hasan is charged with 13 counts of premeditated murder and 32 counts of attempted premeditated murder. He faces the death penalty if convicted.

Attorneys for the AWOL soldier who is accused of plotting to blow up restaurants in Killeen where soldiers frequented say his confession should be thrown out.

Defense attorneys late Thursday afternoon filed a motion in federal court asking Judge Walter S. Smith to deny prosecutors from presenting a confession made by PFC Naser Jason Abdo because they say FBI agents who obtained the confession had denied Abdo his right to legal counsel before the confession was made.

The motion also seeks dismissal of any evidence obtained as a result of Abdo’s July 27, 2011 arrest because defense attorneys claim Abdo was not read his Miranda rights when he was arrested.

Zachary Boyd, a Copperas Cove attorney who is representing Abdo, filed a series of motions Thursday in federal district court in Waco, the last day Judge Smith had set aside for motions to be filed.

Smith also set an April 20 hearing date for motions.

The trial date is May 21.

Abdo initially was indicted on three charges in August 2011.

On Nov. 8, 2011, a federal grand jury in Waco returned a superseding six-count indictment charging Abdo with one count of attempted use of a weapon of mass destruction, one count of attempted murder of officers or employees of the United States, two counts of possession of a firearm in furtherance of a federal crime of violence, and, two counts of possession of a destructive device in furtherance of a federal crime of violence.

If convicted, Abdo could face life in federal prison.

The indictment alleges that on July 27, Abdo attempted to make and detonate a bomb to kill soldiers and then planned to shoot survivors inside an unspecified restaurant frequented by Fort Hood troops.

The original indictment against Abdo returned in August charging unregistered destructive device, possession of a firearm by a fugitive from justice and possession of ammunition by a fugitive from justice remains in effect, but prosecutors said they would proceed first on the charges in the new indictment.

  • What should we expect?  Muslims in the military afforded all rights and privileges no matter the crime (s).

    You think about young soldiers, marines and other service men and women imprisoned in Ft. Leavenworth for supposed rules of engagement crimes.  We know not all are innocent, but there are those who have been used as scapegoats for the actions of those above them. One such young man is Corey Clagett (there are others as well).  I have tried to contact his mother in the last few months, but she has not replied.  Please read Corey's story, and drop him a letter.  I believe he was to have had a hearing back in February, but nothing was posted on the site.  I have a feeling he is still in prison.  One cannot help but think about these young men and the  Muslim  military counterparts who go free, or have special privileges granted to them.

  • I don't think the Judge needs to give the defense any more time - it has been two years since the killings.  The Army at least partially is responsible for what happened since their political correctness kept covering up the Major's problems.  Instead of dealing with him they kept pushing that responsibility to the next person. 

    This wasn't a workplace issue, this was terrorism.  This sob needs to be found guilty and hung.

Just kidding.  It has been three years since he killed 13 innocent people, including an unborn baby.  Shades of Obama!!!!!!  It's time he was tried, convicted, sentenced to death, and shot by a firing squad using bullets smeared with pig lard and dipped in pigs' blood.  Since he murdered all those innocents in public with hundreds of eyewitnesses, the verdict is inescapable.  He is one stupid and barely sane jihadi who needs to see Allah, but cannot enter into Muslim Paradise with his soul so damaged by porcine excremental fluids. I am ashamed that our legal system permits such a travesty of justice as this.

And elsewhere it is appointed for a man once to die -and then the judgement.And still elsewhere Thou shalt not suffer a murderer to live. I take form Scripture that  whatever a military Court  does in it's  desire to please Barak Hussein Obama II  And our corrupted civilian Courts matters not for he will be judged by a righteous judge and answer for the deaths of fourteen innocents  The shedding of innocent blood defiles the land and only the shed blood of Jesus Christ  can restore.

  • We agree it is wrong that he is drawing his pay as a Military Officer -while he  willingly committed an act of war against the very organization paying him .We agree he is evil. I guess my point is he is dead already. I am not certain how much of this legal stuff done purportedly on his behalf  by attorneys is under his control.And in my opine--and I could be wrong- but I think if a man is beguiled by the belief that the only way he can  be assured of his gods favor  is to die in jihad. Allowing him to die as result of his bloody desire  grants him his wish. I would pump him full of good Christian blood--or Jewish blood--and surround him with good strong Christians and Jewish  people to remind him every day he remains above ground how he failed to accomplish his desire to die in jihad-and what an EVIL false religion Islam is.And he would not have any young slaves of Allah to read the bloody Koran to him.And No pay from the US Army.   

  • Sorry if this offends the sensitive, but the judge, Hasan's lawyer and Hasan should all be strung up.  This isn't the way justice is properly meted out!
