The Second Amendment Preservation Act is being introduced in the West Virginia House of Delegates.
This bill nullifies any future gun controls laws, under the 2nd Amendment of the United States Constitution and Article III Section 22 of the West Virginia State Constitution, and makes it a felony to try to enforce such illegal laws in our State.
We have many brave and constitutional delegates sponsoring this bill, but they need your help.
You need to contact your State Delegates and let them know how to vote on this Act, and that their stance on this issue will be remembered will into 2014.

A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new article, designated ----, all relating to preventing Federal or State infringement on the right to keep and bear Firearms, Firearms accessories or ammunition; nullifying all future federal, state or local acts in violation of the Second Amendment to the Constitution of the United States and/or Section Twenty-two of Article III of the Constitution of the State of West Virginia.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new article designated ---, all to read as follows:
The Legislature of the State of West Virginia finds that:
a) As the Second Amendment to the Constitution of the United States reads as follows,:“[a] well-regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed” and as Section Twenty-two of Article III of the Constitution of West Virginia states that “[t]he right of the citizens to bear arms in defense of themselves and the State shall not be questioned”; that, therefore,
b) All federal, state or local acts, laws, orders, rules or regulations regarding firearms, Firearms accessories or ammunition are a violation of the 2nd Amendment along with Section Twenty-two of Article III of the Constitution of the State of West Virginia, and in violation of this act.
X-xx-2. Prohibitions on Federal, State or Local Infringement of the Right to Keep and Bear Arms, Firearms Accessories or Ammunition
a)As a consequence of these findings, the state of West Virginia declares that all future Federal ,State or Local acts, laws, orders, rules, regulations concerning firearms their accessories, ammunition or their accouterments are and shall be deemed to be in violation of the Second Amendment to the Constitution of the United States and of Section Twenty-two of Article III of the Constitution of the State of West Virginia and are not, therefore, authorized by the Constitution of the United States and the Constitution of the State of West Virginia as they violate its true meaning and intent as given by the Founders and Ratifiers, and are hereby declared to be invalid within West Virginia and all of its boundaries.
b) Any and all future Federal, State or Local acts, laws, orders, rules, regulations concerning firearms or their accouterments shall not be recognized by this State, nor be given any recognition within its boundaries, as they are against its specifically stated public policy, are specifically rejected by the State of West Virginia, and shall be considered null and void and of no effect within the state of West Virginia.
c) It shall be the duty of the State of West Virginia to adopt and enact any and all measures as may be necessary to prevent the enforcement of any Federal, state or local acts, laws, orders, rules, or regulations in violation of the Second Amendment to the Constitution of the United States and of Section Twenty-two of Article III of the Constitution of the State of West Virginia or any violation of this section.
d) Any attempt to enforce such Federal, State of Local Laws, Acts or Orders within the state of West Virginia in violation of this Act is illegal, and as such, any official, officer or employee of the United States Government, the West Virginia Government and any County or Local government that infringes upon the Right to Keep and Bear Arms, as provided for within this section, shall be guilty of a felony and, upon conviction, shall be subject to imprisonment for not more than two (2) years, and a fine of not more than ten thousand dollars ($10,000.00).
(e) The attorney general shall defend a citizen of West Virginia who is prosecuted by the United States government for violation of a federal law relating to the manufacture, sale, transfer or possession of a firearm, a firearm accessory or ammunition.
f) This article is effective retroactively to January 1, 2013. No provision of this article shall be construed so as to create any ex post facto law.
Finally! I just sent a copy of this to 6 Tea Party Groups in West Virginia (1 in Hagerstown); to 13 of our representatives, including Mr. Folk; media (local and national newspaper and radio), patriots, friends, family, military folks I have on my mail lists, etc. and asked everyone to pass it around and to CALL their representatives/Senators and tell them to vote for this bill. To tell them we are watching their votes and if they vote against the bill we promise to let everyone know their vote and kick the bums out next election.
The next bill I'd like to see is a protection of our air space against the Drones BO will have flying over our state to spy on our citizens.
I'm also attending a Republican Party meeting (just joined to win friends and influence people) next week and will talk about this with one of the senators (Unger) to see how we can push this issue.
