Congress:Your time is short – very short. You have ALL broken your oath of office and we the people have had enough of it. While I listened on Saturday, Dec. 5 to you quote from “Fact Check.org and various newspaper’s op-ed pages, this is NOT what our Constitution is founded on nor what you agreed to uphold! Do you remember your oath of office? Let me remind you!The current oath was enacted in 1884:I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God.You have blatantly broken this oath over and over again. It is time to bring a halt to your total disregard for the country, your duties, and those who entrusted you to carry out your duties! This constant, endless debate on healthcare, cap and trade, business take over MUST stop immediately! They are ALL UNCONSTITUTIONAL!Article I - Section 8 - Powers of CongressThe Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;First comes the term “general welfare.” We all know the meaning of words can change over time. In order to more accurately assess the meaning of the word "welfare", with respect to its use in the Constitution, I consulted a source from that period. I happened to own a reprint of the 1828 edition of Noah Webster's American Dictionary of the English Language. Here is how the word "welfare" was defined 40 years after it was written in the Constitution:WEL´FARE, n. [well and fare, a good going; G. wohlfahrt; D. welvaard; Sw. valfart; Dan. velfærd.]1. Exemption from misfortune, sickness, calamity or evil; the enjoyment of health and the common blessings of life; prosperity; happiness; applied to persons.2. Exemption from any unusual evil or calamity; the enjoyment of peace and prosperity, or the ordinary blessings of society and civil government; applies to states.A clear distinction is made with respect to welfare as applied to persons and states. In the Constitution the word "welfare" is used in the context of states and not persons. The "welfare of the United States" is not congruous with the welfare of individuals, people, or citizens.Please notice the last phrase of the first paragraph “shall be uniform throughout the United States.” There is nothing uniform in these bills! States are being given several privileges for a variety of reasons. – the main one being to buy a Senator’s vote!Now as to the last sentence of the article I ask you to read the LEGAL DEFINITION OF COMMERCE!“The exchange of goods, products, or any type of Personal Property. Trade and traffic carried on between different peoples or states and its inhabitants, including not only the purchase, sale, and exchange of commodities but also the instrumentalities, agencies, and means by which business is accomplished. The transportation of persons and goods, by air, land, and sea. The exchange of merchandise on a large scale between different places or communities.Although the terms commerce and trade are often used interchangeably, commerce refers to large-scale business activity, while trade describes commercial traffic within a state or a community.”Just how does any of your proposed legislation fall into this category? IT DOES NOT! IT IS AN ILLEGAL TAKEOVER OF PRIVATE INDUSTRY!Section 9 - Limits on Congress(No capitation, or other direct, Tax shall be laid, unless in Proportion to the Census or Enumeration herein before directed to be taken.) (Section in parentheses clarified by the 16th Amendment.)No Tax or Duty shall be laid on Articles exported from any State.No Preference shall be given by any Regulation of Commerce or Revenue to the Ports of one State over those of another: nor shall Vessels bound to, or from, one State, be obliged to enter, clear, or pay Duties in another.No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law; and a regular Statement and Account of the Receipts and Expenditures of all public Money shall be published from time to time.Amendment 16 - Status of Income Tax Clarified. Ratified 2/3/1913.The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.In 1895, in the Supreme Court case of Pollock v Farmer's Loan and Trust (157 U.S. 429), the Court disallowed a federal tax on income from real property. The tax was designed to be an indirect tax, which would mean that states need not contribute portions of a whole relative to its census figures. The Court, however, ruled that the tax was a direct tax and subject to apportionment. This was the last in a series of conflicting court decisions dating back to the Civil War. Between 1895 and 1909, when the amendment was passed by Congress, the Court began to back down on its position, as it became clear not only to accountants but to everyone that the solvency of the nation was in jeopardy. In a series of cases, the definition of "direct tax" was modified, bent, twisted, and coaxed to allow more taxation efforts that approached an income tax.Finally, with the ratification of the 16th Amendment, any doubt was removed. The text of the Amendment makes it clear that though the categories of direct and indirect taxation still exist, any determination that income tax is a direct tax will be irrelevant, because taxes on incomes, from salary or from real estate, are explicitly to be treated as indirect. The Congress passed the Amendment on July 12, 1909, and it was ratified on February 3, 1913 (1,302 days)..Be grateful that we just want you and the Supreme Court our of office and NOT in jail!

I know taking h.c. is just the start of takeovers. i do hope their is someone out there would be on the court steps the minute this is passed and before obama can sign, either way we really need help.
