Progressive US AG Eric Holder recently proclaimed in an interview: “If you want to call me an activist attorney general, I will proudly accept that label,” While this writer is moved to expound that the proper role of the Executive branch under which the US Attorney Falls, is to enforce the laws and regulations passed by Congress, for now he will say no more. This writer believes it is far more useful to illuminate the masses, especially those who presume "activism" to mean advancement of the Liberal Agenda. This illumination will occur by exposing the true nature of Progressive US AG Eric Holder and Progressive President Barrack Obama activism.
In the past few days, several articles regarding the large civil settlements with the “Too Big To Fail” banks have been published. Yet, before we begin our analysis of the treatment of banksters, let us establish some criteria that will be helpful in making our analysis. Those criteria come in the form of common viewpoints that mutually ground rank and file Americans (aka "average", "the masses", "WE THE PEOPLE") to each other.
Perhaps most relevant to our analysis is the average American's belief that unjust enrichment (theft of value produced only by labor), by anyone at the expense of another, is a violation of Natural Law and the Rule of Law. Simply, regardless of political stripe, most rank and file Americans regard such thefts as a crime that must be punished.

Further, most of us rank and file Americans consider it a personal embarrassment to let ourselves to be duped, played or fooled in areas of our personal affairs ranging from buying a car to more obscure social slights.

With those unifying beliefs established, let us talk a little about this writer's perceptions of the two major political parties. In this writer's assessment, the two main political parties in American deliberately and purposely paint two different "perspectives of reality" to their respective memberships. (Rank and file as used here meaning the respective membership of each political party that are not in the leadership, acting as political operatives and/or not selling their votes for salaries, corporate or personal government handouts and/or other forms of consideration)
This writer asserts that the leadership of the two major political parties indoctrinate their rank and files members with dogma creating these two different perspectives of reality for untoward purposes. This untoward purpose being to divide, conquer and distract the masses of America. By creating these widely disparate perceptions of reality, our government succeeds in preventing WE THE PEOPLE from unifying and holding our government, and government officials, accountable. Further, by pitting the rank and file of each party against each other, our Government succeeds in distracting WE THE PEOPLE from the various wrong-doings of our government's various officials and from holding them accountable for these wrong-doings.
For the present matter at hand, there is a particular aspect of the perspectives of reality painted by Democrat and Republican leadership that is most relevant. This writer's observes that the Democrat Party Leadership's dogma and indoctrination of its rank and file members asserts:
- That all Republicans are rich and have built their wealth through the theft of value (produced only by the labor of the masses) from the masses (unjust enrichment).
- The Democrat Party is the defender and benefactor of the Americans who are not rich.
- That the Republican Party is corrupt, gives preferential treatment to big business and fails to harshly punish the crimes committed by big business.
- Rich Republicans, having acquired their wealth unjustly, must have some of their wealth taken from them and redistributed to the less fortunate.
- Big Business must be vigorously regulated and severely punished when it is found committing crimes.
- From the foregoing, it follows that anyone who is not rich must vote for Democrats to protect themselves from the rich Republicans.
The relevant aspect of Republican Dogma used in indoctrinating its rank and file membership into a different perspective of reality asserts:
- The Democrat Party is the Party of unjust wealth redistribution which is unfair and reduces American productivity.
- The Republican Party is the defender of individual liberty, property rights, the Constitution, Natural Rights, the Bill of Rights and tradition.
- The Republican Party stands for law and order pursuant to the Rule of Law (1 set of laws for all citizens regardless of position, wealth or societal rank.)
- What is good for business is good for all Americans - A rising tide lifts all boats.
- Wealth is the reward for undertaking the risk of engaging in free markets.
- Persons who believe in individualism, freedom and free markets should vote Republican

And with the foregoing boilerplate in place, the analysis of the differences in the treatment of Bankers by the two major parties proceeds very quickly.
Democrat dogma proclaims that Republicans let big business get away with massive unjust enrichment and crimes. And, that in the process rank and file America is victimized. And it is only the Democratic Party that is the protector of the American masses. But it is here the dogma of both major political parties begins to unravel.
Regardless of political stripe, we rank and file Americans believe crime should be punished pursuant to the Rule of Law. That means criminal prosecutions to not only punish but to deter future and repeat crimes. The reasonable expectation is that the Democrat Leadership would error on the side of criminal prosecutions in championing the best interests of its rank and file membership.
However, for all of the Democrats saying they are the champion of masses, Democrat President Barrack Obama and Democrat US Attorney General Eric Holder have been letting the rich banksters off with no criminal prosecutions. Instead, Progressive President Barrack Obama and Progressive activist US AG Eric Holder (head of the Department of Justice) have decided to give these bankers "wrist slaps" with civil penalties. This writer asserts these three points:
- Civil Penalties are a far less deterrent and punishment than criminal prosecution and jail terms.
- Civil Penalties do not cause bankers to shut down other criminal activities that were not discovered.
- Civil Penalties amount to the Government just demanding its cut of the booty stolen from the masses (similar to how a Mob Boss wants a cut of the profits from crimes committed on their turf).
Here is a list of examples of civil, instead of criminal penalties being exacted against banks in America, under Progressive President Barrack Obama's Administration and Progressive US AG Eric Holder's Department of Justice:

From this list it appears that not only these banks too big to fail, they are so big that the banksters that run them are too big to jail. Or are there other forces at work in this equation. What is going on behind the scenes that is not being reported?
This writer has had his own experience with a Too Big To Fail bank now known as Wells Fargo Bank, NA 20+ years ago. One can only speculate about what witnesses were threatened and evidence destroyed in the more recent Too Big to Jail Bank cases. And, what advice, collusion, campaign contributions, bribes and or other consideration involving Government officials who are supposed to represent WE THE PEOPLE also remain in the realm of speculation.
Which causes off of us to ponder, exactly who is supposed to be making sure the victims of these unjust enrichment crimes are being made whole? Even when the civil settlement funds are distributed, there is great question as to whether the real victims of the crime are ever made whole. As is pointed out in the first example, a great portion of these settlement funds go to government agencies who have a very for track record for making sure the funds get distributed to the actual victims. Doesn't our common expectation expect the actual victims of the crime to be made whole?
Still, perhaps the most overlooked part of these folks in all these criminal bank scandals not being charged criminally, is they never acquire a criminal record with most often prevents them from being bank officers and victimizing the public in the future. In one case, the civil penalty included a requirement that one banker not serve on any bank board for 3 years. It’s this simple, criminal prosecution protects all rank and file Americans by preventing these bankers from being in the position to repeat the crime. First, if they are in prison their opportunities for repeating the crime are greatly limited while doing time. And second, as we have said criminal convictions most often preclude these convicted bankster's of later again securing a position to allow them to perpetrate and/or aid and abet in the perpetration of a same or similar crime again. (There are numerous allegations floating that "not being charged criminally" is most often a matter of making the write campaign contribution, bribe and/or other consideration to the right person.)
Still further, it is not as though this "unjust enrichment" these banksters and our government were complicit in was some minor market correction. These criminals diminished and/or destroyed the lives of almost all rank and file Americans from 2007 to present 2014. (And there is no end of misery in sight.)
Between 2007-2012 a wealth transfer of $24 Trillion to $45.1 Trillion (depending on whose numbers you believe) occurred in American.
It is no mystery to this writer why the American economy is not recovering. This entire $24 Trillion to $45.1 Trillion wealth transfer went from persons who did not have insider knowledge of what was transpiring (rank and file Americans) to our elected officials and their friends. Rank and file Americans spend the money they have in order to live. Our elected officials and their friends can only have so many cars, boats, houses and trysting partners; their portion of this booty ends up savings and investments that do not stimulate the economy.
And record numbers of adult Americans don't have and/or have given up on finding jobs:
With the magnitude of the damage these banksters and their complicit government officials inflicted on the masses, this writer asserts that criminal sentences should be the rule rather than the exception and that the amount of the civil penalty should be the amount necessary to make the victims completely whole, not some arbitrary number negotiated (wink, wink - nudge, nudge) in smokey back rooms or in erased emails.
This writer asserts that the sheer magnitude of the damage inflicted on rank and file Americans should move the rank and file members of both major political parties to question the duplicity of their respective party leaders.
Where is the law and order pursuant to the Rule of Law and protection of property Rights espoused by the Republican Party Leadership? Oh, sure. The GOP excuse is that the Democrats have control of the executive branch. And, by extension, the Department of Justice, via President Barrack Obama and US AG Eric Holder. And in that the DOJ has control of the handling of these cases; the Republican Leadership passes the buck on the responsibility for these banksters not being charged criminally onto the Democrat Leadership.
With all these facts on the table, any critically thinking rank and file Democrat must acknowledge that they have been duped, played and/or fooled by Democrat Party. The Democrat Party tricked you into believing that Democrats were the champions of rank and file Americans, and their failure to prosecute these banksters evidences that is not the truth. From the examples of civil settlements this writer has provided, there can be no doubt that the Democrat Leadership coddled the bankster's, exactly as they have accused the Republican Party of doing.
While President Barrack Obama and the Democrats were giving you Obamacare with one hand, they were busy divvying up the $24 Trillion to $45.1 Trillion in booty stolen from the masses between 2007 and 2012 with the bankers, in exchange for letting the banksters get off with no criminal charges, etc., etc. Being truthful with yourselves, "How do you rank and file Democrats feel about that?"
Now let’s do some more chess move analysis. How is it possible that even though the logic and substance of both major Party Platforms and Dogma require the victims of crime to be made whole, the banksters were not charged with a crime and the victims were not made whole?
And, lest the Democrats think this independent conservative is unfairly holding them out for criticism, let’s visit some Republican examples of departure from Republican Platform and Dogma. Does anyone remember Speaker Boehner, Senator McConnell and the Republican Leadership attacking the TEA Party though everything the TEA Party wants is already in the Republican Platform? Further, this writer personally attest to experiencing blow back and retaliation for bringing forward resolutions on Judicial Reform and Fiscal Transparency as a delegate, even though these resolutions were clearly consistent with the Platform and Dogma of the Republican Party and popular with the rank and file membership as evidence by passing successive votes before the resolutions were mysteriously "lost" by the GOP Leadership.
Using more Chess logic, there seems to be a parallel between the workings of both the Democrat and Republican Party. Clearly, platforms of each party reflect the will of the rank and file membership as they are created by the rank and file membership of both parties. Yet the leadership of both major political parties no longer feels obligated to follow their respective party platform.
This writer alleges that a group known as Progressives has taken over the leadership of both major political parties. First, they openly took control of the Democrat Party leadership. And more recently they have taken control of the Republican Party leadership. RINO is GOP Politically correct for Progressive Republican. (My regular readers and my followers on Twitter @DMashak already know this writer regularly labels and attacks the current Republican Leadership for being Progressive.)
Progressives believe that folks known as Educated Elites should run government. Progressives believe these Educated Elites should be free to make decisions without being accountable to the masses as they are smarter than the masses. Progressives resent the restrictions of our current Jeffersonian Constitution and want to replace it with one of their own design. Finally, if you dig deeper into the history, foundations and philosophy of Progressivism, you will find that Educated Elites are to be selected from the wealthy, leisure class. In other words, the very persons Democrat Dogma blames for the injustices to the masses are the persons Progressivism prescribes the Educated Elites be selected from among and allowed to run the government with even less accountability to the masses.

With the leadership of both major political parties now controlled by the Progressives, we can deduce two facts:
- As well as ignoring the will of rank and file Americans as expressed in the respective party platforms, Progressives have also determined they are not bound by the ethos and morality of rank and file party members. (Actions speak louder than words)
- Progressives are the folks who decided that $24 Trillion to $45.1 Trillion could be stolen from the American Public from 2007-2012 and no banksters would go to jail.
- Being led by Progressive leaders who will not abide by the will or morality of rank and file Americans is an unacceptable state of affairs.
And, this unacceptable state of affairs allows requires us to contemplate and anticipate some future political chess moves to resolve this unacceptable state of affairs. This writer suggests the following as the best courses of action to be considered:
- Rank and file members of each party need to start identifying and voting out all Progressives.
- Center-left and Center-right Americans should consider forming a third alternative party together.

In this writer's humble opinion no simple, status quo election will fix the problems WE THE PEOPLE face. I can say it no plainer.
