I've long opposed the methods used by the TSA ever since they were created after 9/11. While I'm infuriated that our government has stooped to such invasive measures, I'm more pissed that so many Americans could not care less about it. How many times have we heard "if that what it takes to keep us safe…" followed by [insert the government intrusion policy]? It's funny that the same people that were complaining about the Patriot Act's wire taps are the ones that now have no problem with the government tapping into our underwear.



The 4th Amendment states: "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."


Before we break this down, it's important the people understand why we even have a 4th amendment. It comes from a case in the 1760s. There was a lot of smuggling in colonial Boston and British customs agents were given blanket warrants to search anyone, anywhere. Not only could they search anyone wherever they desired, but they had the power to force citizens to assist in the searches. Some merchants filed a losing lawsuit, but the fight empowered opponents to British rule. John Adams would call this case the birth of American independence. The government was out of control and needed to be contained. James Madison and John Adams would later fight hard to ensure that this right was included in the Constitution.


"The right of the people." The second paragraph of the Declaration of Independence begins, "We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness." What is liberty but the absence of outside influence over our lives, especially that of the government. The Constitution and the Declaration were written solely out of the belief that the government should have a LIMITED role in our lives, thus ENSURING liberty which is an essential right.


We have the RIGHT "to be secure in their persons…against unreasonable searches and seizures." What is our person? It's our bodies. Our selves! The question could well be asked by proponents of an ever-intrusive government what the meaning of "unreasonable" is. Is it unreasonable to fondle a 8-year old to surmise if he/she is carrying explosives or contraband? Is it unreasonable that ANYONE can be forced by the government to a virtual strip search or molestation at the hands of a government agent? Who holds the patent on what constitutes "unreasonable?" Hint: it's not the government! It's you and me! WE decide what is unreasonable, not the government. WE decide and the government enforces.


The problem is that too many people are too apt to completely dismiss their rights guaranteed under the Constitution in the name of "safety." Too many people have surrendered their rights, giving the government the belief that they are justified "unreasonable searches and seizures." The government only has authority and power to do what we, the people, give it the authority and power to do. The British goons of yesterday are the TSA goons of today. They are no different in trying to strip us of our "inalienable rights" to personal liberty.


The 4th amendment goes on say that "no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized." The amendment places lists three limits of the government: the warrants must be supported by probable cause, they must define where the search is to take place, and they must define what the object of the search is—who or what is to be seized. There is no such thing as a random warrant anywhere but at the airport and yet no one seems to care about that? All in the name of secure flights, even though if a terrorist really wanted to blow up a plane, he wouldn't necessarily need to be a passenger on one!


This is where the government has failed the people. TSA agents are not trained to identify suspicious individuals. They are trained to randomly select innocent Americans and violate their rights. Where are the trained social observers reading the faces and mannerisms of every passenger wishing to use a plane to get from point A to point B? As an interrogator and debriefer, I'm trained to read people's actions, facial expressions, body movements and even how and what they write. I can spot a guilty person from across a room, which is why I was so successful as a retail store detective before joining the Army and as an interrogator in it. Where are the TSA's "social monitors?"


I'll tell you where they are – buried in political correctness! For some unknown reason, it's politically correct to remove the breast or spill the urine of a cancer survivor or feel up an 8 year old child than to watch people and make an educated guess about who is suspicious. Our government says, "we're only looking out for your safety" when in reality they're taking the easy way out by issuing the blanket warrants that gave birth to the 4th Amendment.



There are baselines that everyone has. If I ran the TSA, trained social monitors would be spread all over the terminal, identifying "suspicious" individuals the moment they stepped out of their car. The baseline observation would start from the moment they are visually picked up. Any deviation from their mannerisms while moving through different environments would tip off an agent for a screening. Standard questioning techniques would quickly identify a guilty party or alert the agent to an innocent citizen, preventing further violations.But, that's just too hard for our government. It's more important that our citizens be inconvenienced instead of our government officials.


Specialized training takes a back seat to potentially dangerous technology that allows government official to get their sexually deviant kicks. In legal jargon a "search" is any tactic that infringes a "reasonable expectation of privacy." A reasonable expectation of privacy is the kind of expectation any citizen might have with respect to any other citizen. This is the argument we are hearing all over the place today: "if I can't come up to you and place my hands on your private parts, the government shouldn't be able to either." The Supreme Court has upheld this standard (Mapp vs. Ohio – 1967), but our government trots along and I continue to hear people say, "I don't mind!"


The bottom line is that we have these rights so long as we're willing to exercise them. When we cease to care about being felt up by our government, we lose our rights. A false sense of security is no reason to violate those rights that our ancestors fought so hard to obtain. Benjamin Franklin famously said, "Those who would sacrifice freedom for security deserve neither." Amen, brother!

"Serving as I am here in Afghanistan many of you ...have asked me why I am here. I have replied that if asked to execute an illegal or immoral order I would refuse and I still hold to that. My point here is that were I a TSA agent...I would refuse orders to do what they are now doing. Those of you still clinging to the notions that our government is not corrupt and that it considers the defense of our liberty as anywhere near the priority that the founders did need look no farther than what is going on at the TSA. These are not solitary random acts of disgruntled agents which does not reflect the ethics of the rest of the agency...this administration and this agency are perpetrating these acts upon us knowing full well what they are doing and yet they tyrannize us anyway. When will you rise up America and fight for your freedom? Will it be after your sisters and your mothers and your wives are molested by government agents? When will you say that the degradations are too great? The founders who espoused to the notion that no exchange of freedom for security was a worthy bargain would be ashamed of what we have allowed already and I say it is time we told the government enough. Don't fly if you can avoid it. Don't go through the scanners if you must fly and video any and all searches to be used in court against the agents and agency at a later time. "Following orders"
has never been a viable excuse for committing sexual assault and those of you being grope searched should seriously consider filling charges against even individual agents. WAKE UP AMERICA, ITS TIME TO FIGHT FOR LIBERTY!"

    The only probable cause they would have to search anyone would be to search those that have a history of terrorist acts.
    Probable cause being the fact that the only people that have ever committed acts of terrorism on aircraft are those of Muslims of Islamic belief and from countries of the same.
    You see this has been nullified by political correctness [ie] profiling.
    It's not the pretty blond girl from the Midwest, the Catholic Nun, the grandmother with a walker, the little ten year old boy,or the white businessman from New York,
    It's Muslims from the the Middle East and other Islamic countries from around the world. These are the people that need to be focused upon.

    • Your statement about the only people who have committed terrorist acts on airplanes being Muslims is, unfortunately incorrect, here. My Dad was a commercial pilot from the late '40s to the mid-'70s, so even as a kid I was more aware than most, what was going on on airliners, even overseas, which was mostly where he flew, including into Muslim nations,like Egypt, Kenya, Tanzania, and some others, as well as Israel, India, Thailand, and most of western Europe. It's been quite awhile, but some of those radicals not unlike Bill Ayers, in the '60s especially, who were of a communist/ Marxist bent also committed acts of terrorism on planes, which, fortunately for us, were largely confined to Europe, Asia, and Africa, but did involve American owned and operated airlines and crews, and American passengers too. It wasn't until about the time Dad was retiring that the Muslims began doing such terrorist actions, but that was when they officially declared war on America and the West, really. And in the past 35 or so years they have been the predominant source of terrorist activities, on or off airliners.

  • I have friends that have bought their own aircraft just to get past the tsa asses he and his wife got tired of getting groped and felt up every time they flew, now they just go to the private plane area and climb aboard and their off. Wish I had that kind of money to do that. The tsa is totally out of control and the pics. that they are taking with those dam machines some of them are finding their way on to the porno sites this has happened to a couple of friends of mine one was the picture of their 13 year old daughter that had the heading of "she is ready now" I'll leave that up to you. The other was of a nine year old boy the friends showed me both pics. these machines can take very detailed pics and store them for later viewing or down loading. We need to stand up to these people( monsters). The government has just grown to big for it's own good their left hand does not know what the right hand is doing, and most of all half of the tsa are perverts and have been convicted of a least one state crime, and yes they do hire people with a criminal back round, so not only are you getting groped but you might even get molested by them if your not careful. Check out some of the videos that are going around the net these perverts like the children more than the adults but they go for what ever they can get and that being they get their jollies off. these people need to be stopped at any cost.
  • How about Big Eared Barry let Manchelle and his two girls get stripped naked by a machine and then molested and strip searched in front of everyone on LIVE NATIONAL tv. While we are at it, have all of the corrupt administration involved go through this with their family. Then we will see how well they like it and how fast it ends. I bet Pelosi will throw a fit when she is asked to either get scanned or groped. Then again she might like it.... It has been decades since either for her.
  • The tsa they are to full of them selves they think every body is doing something wrong just by getting on a plane. These people need to come up with a better way of doing things instead of groping and feeling little children and old ladies, I mean come on what's an old lady going to do. I know a disabled VET that was removed from her wheelchair and searched and then had to get back into the chair by herself these bozos have no heart all they are, are what you call robots and that is how they act. if they let the maslams through with out checking them then there is something wrong. if I have to be checked then so do they.
  • This MIGHT makes some sense IF they were submitting EVERYONE to such searches and 'scopings, but since those who are MOST apt to BE the threat are exempted then NO ONE should submit to either and should sue for false arrest if detained as threatened by TSA if they didn't comply with the porn or molestation! I had no choice about that when I was a baby, but I sure as hell do now and NOBODY is doing either to ME!
