Where the People's Grand Jury Gets Its Authority

For those who challenge what statutes allow the People to form their own Grand Jury based on Common Law (or any law for that matter), read US v Williams, 1992.

 

The following quotes and opinions will help settle the issue. The simple fact is: The power resides in the People; the People have never consented to any prohibition of that Right. The People have decided.

 

"If we have not Courts that are established and maintained by the People, rather than by bribable Judges, then we will have no Republic … Our Constitution and our Nation will rise or fall according to the independence of our Courts."

To be a True Grand Jury, it must be a creation of, by, and for the People; independent of control, manipulation, and perversion by courts, attorneys, and other nefarious external influences. The future of our Republic depends on this institution, and its fidelity to truth, honor, and mercy.                                                                                                                     --Tom Payne

This Court's cases relying upon that power deal strictly with  the courts' control over their own procedures, whereas the grand jury is an institution separate from the courts, over whose functioning the courts do not preside.

"Rooted in long centuries of Anglo-American history”, Hannah v. Larche, the grand jury is mentioned in the Bill of Rights, but not in the body of the Constitution. It has not been textually assigned, therefore, to any of the branches described in the first three Articles. It ‘is a constitutional fixture in its own right.’ United States v. There has never been found any prohibition by statute or law, against the formation of a Grand Jury of, by, and for the People, to protect themselves from corrupt bureaucracies and overzealous prosecutors.     Mr. Timothy Syrell,,,,, I also thank you for your comments and thought.

    I think you're right in may instances. We do need to reach out to all races and communities that this current state of affairs is not right and should never be tolerated.

    However the point that I feel that you missed is that it doesn't matter to the people who are driving this Furguson MO riots, they don't care about right or wrong, good or bad, justice or racism. The only thing that matters to them is the tension and unrest in America, they NEED these riots. They NEED this racial tension. They NEED this political division. They NEED and WANT America to explode internally. The worse things get - the more they like it, and the more they benefit from it.
    We are not dealing with just simply racial tension here over a black kid getting killed by a white cop. Except for the fact that it happened, that actually has nothing to do with any of this. And this mess has nothing to do with rich virsus poor, or economic inequality. It has nothing to do with jobs, education, or income. The only thing that matters here (with the people driving this) is the systematic destruction of American Civilization and culture. The only way they can destroy America is from within. And that is the goal, the design, and the ultimate intention of these people. The Ferguson Riots, and the blacks that are currently being stirred up to fight, these people hope the cops are stupid enough to kill a few more of them. Maybe 10-15,,,, that would help, ----- the cause at least.

    The blacks are being used,,,played like a cheep $2.00 fiddle.

    And so are we.
